By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our services.

2. Description of Services

Mesmer Automation provides software-as-a-service (SaaS) automation solutions. The specific features, functionality, and scope of services are determined on a per-client basis and outlined in your individual service agreement.

3. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable laws
• Provide accurate and complete registration information

4. Account Responsibilities

When you create an account with us, you agree to:

• Maintain the confidentiality of your account credentials
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach
• Ensure that your account information remains accurate and up-to-date

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in fraudulent, deceptive, or misleading activities
• Interfere with or disrupt the integrity of our services

6. Payment Terms

You agree to pay all fees associated with your use of our services as specified in your service agreement. All fees are quoted in Swedish Kronor (SEK) unless otherwise stated.

6.2 Payment Processing

Payments are processed through secure third-party payment providers. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

6.3 Refunds

7. Intellectual Property

All intellectual property rights in our services, including software, designs, trademarks, and content, are owned by Mesmer Automation or our licensors. You are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these Terms.

Your use of our services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to such processing.

9. Service Availability

While we strive to maintain high availability, we do not guarantee uninterrupted access to our services. We may modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

10. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MESMER AUTOMATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mesmer Automation and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising out of or relating to your use of our services or violation of these Terms.

13. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
